Guardianship/ Conservatorship Case?

 

Involvement in the guardianship/conservatorship process can be very disturbing for individuals and families. Petitioning is often painful and distressing, and petitioners usually feel it is their only resort. The person for whom a guardianship/ conservatorship is sought may feel threatened or betrayed because they stand to lose the right to make basic life decisions.

 

Mediation eases the difficulty of this process by giving all the parties involved a chance to talk about the problems that prompted the petition. They can try to work out a solution which addresses those problems and is acceptable to all parties. Through mediation, all parties can find out about the ser­vices and options available to help with their situa­tion. They can perhaps find a solution to the prob­lem which does not require a court hearing.

 

 

 

How Do I Have My Case Mediated?

 

If the court feels that your case would benefit from mediation, the court will invite you to participate.

 

Even if the court does not suggest mediation, you may call the Center to request one. You will speak with our Case Manager who will document some basic information and answer your questions about the process. The other parties will be contacted by the Center to obtain their consent to mediate. If all parties agree, then a session will be scheduled.
